I would like to get an opinion on a design patent that I believe is egregiously overzealous and broad to the point of stifling innovation and abusing the intent of patent law.

not a single comment? This is getting fairly frustrating. Every time I turn around with a new product idea, it is patented. Patents are out of control. And China copies everything anyway and sells it back to the US for less than we can manufacture it.
Getting a patent on a product is a long drawn out ordeal, and I’ve seen costs run upwards of over $20k.
Can’t really say more as I have no experience with this but have looked into it myself since I have a few specific products that no one has a patent on.
Having consulted with someone though taught me it’s just really expensive to do altogether. And if the Chinese do happen to copy it, well there’s nothing you can do anyway being based in the US.
Yes, I know about the cost. I have spent $,$$$'s defending myself against Milwaukee. I’m thinking its time to give up on the maker business. Everyone and their grandma is doing it.

Exactly. I know of a TERRIBLE one. Cost me money. Didn’t really do his research. I told him things I found out and his reply “Where did you get that information?”

If you wanted people to commiserate with you then put that in the post. Otherwise, I’m not going to google patent attorneys and vet one for you.
Since it seems like you want moral support, I agree whole heartedly that patent stuff sucks and china copies things.
There is also a negative side of Patents. Once you apply, the idea, illustrations, descriptions are released to the public. I have 2 patents in progress, one is being currently assessed by the patent assessor and one we are still putting together, these are not my patents as such. Its through my employer (we design machines for oil and gas pipeline installations) but I am down as the inventor.
I get emails all the time from leeches that scoured the patent website praying on people. Point being, before your patent is even approved, it could be in mass production somewhere else if they think its a good ideas. Some times best just to keep it quiet and make what money you can.

I guess being an engineer I am a bit too literal. I didn’t see the OP as a conversation starter either, sorry about that. My brother has 5 patents but had to go through the University to get them due to the cost. I don’t think he has made much money off of them due to the cost associated with obtaining them and partnering with the university to secure them. I know people who have made allot of money off things they have patents on… but that was decades ago. Things are so different now… its hard for an individual to navigate the patent process… unless you have deep pockets and the ability to get the product in circulation quickly.
Huh? I even agreed with you. I just gave you some shit for complaining that no one wanted to engage because it clearly wasn’t obvious to anyone that you wanted anything other than a patent attorney.
